Where a defendant in a criminal case had been detained for a police line-up pursuant to a court order upon evidence which established probable cause for his arrest, a witness's identification of him in the line-up was admissible in evidence. [674-677] At the trial of indictments, there was no error in admitting in evidence an in-court identification of the defendant by a witness whose two previous identifications of him from photographs had been excluded as suggestive, where the Judge found, on sufficient evidence, that the in-court identification was the result of means sufficiently distinguishable to be purged of the primary taint.
