I believe that the Opinion in Support of Affirmance erroneously adopts a policy driven approach to determining whether a prior conviction in another jurisdiction constitutes an equivalent offense for purposes of applying the mandatory recidivist sentencing provisions of 75 Pa.C.S. 3731. For the reasons that follow, I would reverse the order of the Superior Court.
